The short version
Fluxway helps you draft and send 1:1 emails from your own inbox. You stay in control and you're responsible for what goes out under your name. We provide the tool honestly and as-is during the pilot. These terms set out the deal between us.
Agreement
These Terms of Service are a contract between you and Fluxway ("Fluxway," "we," "us"). By creating an account or using the service, you agree to them. If you're using Fluxway on behalf of a company, you confirm you have authority to accept on its behalf.
What Fluxway does
Fluxway connects to your mailbox, uses AI to draft replies and follow-ups based on the product activity and context you configure, and sends the messages you approve from your own email address. Fluxway is a drafting and sending assistant — it does not guarantee any particular business outcome.
Your account
- You must provide accurate information and keep your password secure.
- You're responsible for activity that happens under your account.
- The pilot is invite-only; access may be granted, limited, or revoked at our discretion.
Your responsibilities
You are responsible for every email sent from your connected mailbox through Fluxway, whether you approved it manually or via settings you enabled. By using the service you confirm that:
- You have the right and a lawful basis to email the recipients you contact.
- You will comply with applicable laws, including anti-spam and privacy rules such as CAN-SPAM, GDPR, and CASL.
- You will review drafts before they send and honor opt-out requests.
- The content you send is truthful and not misleading about who it's from.
AI-generated drafts can be inaccurate or off-tone. Treat them as a starting point and check them before they go out.
Acceptable use
You agree not to use Fluxway to:
- Send spam, bulk unsolicited mail, phishing, or malware.
- Harass, deceive, impersonate, or harm others.
- Violate any law or any third party's rights.
- Circumvent sending limits or other safeguards, or disrupt the service or its infrastructure.
We may pause sending or suspend accounts to protect recipients, deliverability, our providers, or the service.
Sending, approvals & limits
Emails send according to the approval and timing settings in your workspace, including any review window before a queued draft goes out. We apply sending limits and pacing to protect your domain's reputation, and these may change. Once an email is sent, it cannot be recalled.
Third-party services
Fluxway relies on third parties — your email provider, our email connector (Unipile), Anthropic for AI, and any analytics source you connect. Your use of those services through Fluxway is also subject to their terms, and we're not responsible for their acts or outages. See our Privacy Policy for how data flows between them.
Pilot & availability
Fluxway is offered as an early-access pilot. Features may change or be removed, and we don't promise any specific uptime during this period. We may modify or discontinue the service, in whole or in part, at any time.
Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI output will be accurate or suitable.
Limitation of liability
To the maximum extent permitted by law, Fluxway will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service — including emails that were or weren't sent. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the three months before the claim, or US$100.
Termination
You can stop using Fluxway and delete your account at any time from Settings. We may suspend or terminate access if you breach these terms or to protect the service. On termination, your right to use the service ends; sections that by their nature should survive (such as disclaimers and liability limits) will continue.
Changes to these terms
We may update these terms as the product evolves. When changes are material, we'll update the date above and, where appropriate, notify you. Continuing to use Fluxway after changes take effect means you accept the updated terms.
Governing law
These terms are governed by the laws of the jurisdiction in which Fluxway operates, without regard to conflict-of-law rules. Disputes will be handled by the courts located there, unless applicable law gives you a non-waivable right to a different venue.
